Explanation;

Part I – for online design services only

Part II – for Design & Build Service we subscribe to standard of The JCT Design and Build Contract which is designed for construction projects where the contractor carries out both the design and the construction work.

Part I

By requesting a design service via our Online Design service, at www.ad3london.com you (the client) agree to the following terms and conditions and by commissioning services from AD3LONDON you agree to be bound by these terms and conditions of sale (the “Terms”). If you do not agree to all of the Terms, then do not order or check the “I accept the Terms of Sale” box or order services from the website. If you pay the agreed fees or check the “I accept the Terms of Sale” box, the Terms are fully accepted by you. If you agree to the Terms on behalf of an organization, you hereby represent to AD3LONDON. (as defined below) that you are authorized to accept the Terms on behalf of such organization.

Product Description.

All AD3LONDON design services are delivered digitally via your personal portal document exchange or email in an Portable Document Format (PDF) file. Physical hard-copy plans may be
requested at an additional cost. We attempt to describe and display the Services offered on the Website as accurately as possible; however, we do not warrant that the descriptions or other content on the Website are accurate, complete, reliable, current or error-free. Unless you are provided with information to the contrary from us and subject to our Buyer’s Remorse Clause stated below, all sales are final. Every effort has been made to ensure that all designs, products and services recommended in AD3LONDON (design services and plans) are accurate. All services provided by AD3LONDON are to be considered design recommendations only. All designs, products and services recommended in the plans should be confirmed by you for accuracy and suitability prior to purchasing.

Terms of Service

Our Online Design service is a virtual design service. For the specified fee, a tailored digital design will be e-mailed for you to execute & implement the design yourself.
For the Online Design there will be the option of one set of revisions should the original design not be deemed to be ‘on brief‘at the discretion of AD3LONDON.
Full payment or agreed amount to start the project will be taken up front via link provided by email (utilising our payment provider). Once payment has been received, an invoice will be e-mailed as confirmation along with a list of information required from the client by way of a design brief. ad3london.com Design accepts no responsibility for false, unclear or inaccurate information provided prior to design work proceeding. Once all the relevant information has been received, design work will commence.
Time frames for our Online Design services are estimates. Once a full brief has been received precise timings will be agreed. The turnaround time of designs is dependent on other design projects ad3london.com may have going on at any given time.
Any floor plans provided as part of our Online Design services are drawn as accurately as possible based on the information/measurements provided by the client. It is the client’s responsibility to check that floor plans are correct and accurate before carrying out design work, hiring specialist trades and ordering furniture and decorative items.

Copyright

Our digital Online Designs are ‘copyright’ and no modifications, alterations or reproductions of our designs are permitted without our express written agreement.

Data Protection

ad3london.com does not collect any personal data of any kind and therefore does not hold any. We only require your email address and name that you provide for the purpose of communicating. By requesting a design service via our Online Design service, at www.ad3london.com you (the client) agree to the following terms and conditions and by commissioning services from AD3LONDON you agree to be bound by these terms and conditions of sale (the “Terms”). If you do not agree to all of the Terms, then do not order or check the “I accept the Terms of Sale” box or order services from the website. If you pay the agreed fees or check the “I accept the Terms of Sale” box, the Terms are fully accepted by you. If you agree to the Terms on behalf of an organization, you hereby represent to AD3LONDON. (as defined below) that you are authorized to accept the Terms on behalf of such
organization. No payment data is collected as it is done through trusted third party provides that are fully compliant with GDPR. In instance that we are supplied by you of any personal data we shall immediately delete it. Your information will not be passed to any third party without prior consent except where we are required to do so by law for example, under a court order or in response to legitimate demands under the rulings of UK Data Protection legislation.

AD3LONDON scope of work / services;

1. AD3LONDON has been retained to provide interior design services only.
1.2. AD3LONDON is not a general contractor and will not act in such capacity.Any issues concerning construction elements must be discussed between owner and the contractor.
2. Where AD3LONDON is responsible for organising Third Party companies, firms or individuals (“Third Party Suppliers”) to undertake certain work for the Client, such as
decorating, building work, carpet fitting, curtain and blind manufacture and fitting and such other work during full packages, the contract of work is between the client and the
contractor and not with AD3LONDON so we can not be held responsible for any damages or inconvenience caused by ‘third party suppliers’ but will do our best to mediate on your
behalf should it be necessary and payment was through AD3LONDON
3. Due to the nature of the Interior Design business we cannot guarantee that Clients will always like our recommendations. Interior Design can be subjective.Unfortunately, we
cannot provide any refunds in this case and it is left to AD3LONDON discretion. However please feel free to contact AD3LONDON on contact@ad3london.com and we will be happy to
discuss the design concept further with you and perhaps make further recommendations via phone/email in special cases.
3.2We can not refund the package once work has started on your project. Changes can be made at an additional fee for the time taken to make the amendments.

4. Cancellation and Termination Policy

4.1 The Client has the right to cancel this contract at any time up to the end of 2 (two) working days after the day on which the Contract is concluded, subject to the following provisions. A working day is any day other than weekends and bank or other public holidays. Cancelation should be initiated through contacting ad3london.com on contact@ad3london.com
4.2 The Client will be refunded 80% of the agreed fee up to 2 (two) days (48hrs) provided that client has contacted AD3LONDON via email on contact@ad3london.com
4.3 Termination of contract will not affect AD3LONDON outstanding rights or duties, including
AD3LONDON.’s right to recover any money owing to it under these terms and conditions.
4.4 AD3LONDON shall have no Liability to the Client for any loss, damage, costs, expenses or other claims for compensation arising from any information or instruction supplied by the client which is or are incomplete, incorrect or inaccurate.
4.5 AD3LONDON shall not be liable to the Client for any unforeseeable loss or damage arising from the provision (or non-provision) of the Services, including loss of profit or consequential loss or damage.
4.6 AD3LONDON will not be liable for any failure to perform its duties under this Contract due to circumstances beyond its control,including without limitation flood, fire or otherwise adverse weather conditions. To enable AD3LONDON to deal with any complaints that may arise relating to the Services, the Client must provide full details of any complaints within 7 days of the supply of the relevant services via contact@ad3london.com.

Nothing in these Terms and Conditions affects any liability for death or personal injury attributed or perceived to be caused by AD3LONDON.’s negligence or for fraudulent misrepresentation.

(5) Buyer’s Remorse Clause.

5. If you are unsatisfied with your purchase from AD3LONDON for any reason, you may cancel your purchase and receive a refund of 80% of the agreed fee at any time
prior to project start with your AD3LONDON designer. Once your agree on project start and AD3LONDON confirmed that your project start has taken place no refunds
will be provided.

To qualify for a refund, your cancellation request must be received by our customer service team prior to project start with your AD3LONDON designer. To make a cancellation request contact: contact@ad3london.com
5.1 Service Provider’s Remorse Clause. AD3LONDON has a no bullying, no verbal or written abuse, respectful communications policy.

REFUNDS

5.2Due to the nature of interior design services, refunds cannot be offered once the project has commenced. For the purpose of these terms, ordering of the required items if
instructed by you and sourcing them will be within the definition of project commencement. Additionally, you should take note that you may not always be satisfied
with our recommendations and ideas, but this shall not form a basis for refunds. If however you cancel an order before project commencement, 80% refund will be issued
within 14 days of cancellation.

6. EVENTS OUTSIDE OUR CONTROL

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by an Event Outside Our Control.
An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil
commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence,
epidemic or other natural disaster, failure of public or private telecommunications networks or non-performance by suppliers or sub-contractors.

6.1If an Event Outside Our Control takes place that affects the performance of our obligations under these Terms: we will contact you as soon as reasonably possible to
notify you; and our obligations under these Terms will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside
Our Control. Where the Event Outside Our Control affects our delivery of Goods to you, we will arrange a new delivery date with you after the Event Outside Our Control is
over. Where the Event Outside Our Control affects our performance of Services to you, we will restart the Services as soon as reasonably possible after the Event Outside Our
Control is over. We will only cancel the contract if the Event Outside Our Control continues for longer than 12 weeks in accordance with our cancellation rights in these Terms.

(7) Payment Disputes.

Subject to our Buyer’s Remorse Clause stated above, if you dispute any charge for purchases of Services on the Website, you must notify AD3LONDON at contact@ad3london.com within (7) days of any such charge; failure to notify AD3LONDON. shall result in the waiver by you of any claim relating to such disputed charge; and charges shall be calculated solely based on records maintained by AD3LONDON.

8. Types of Sales.

AD3LONDON accepts orders for Services through the Website. You may place your order on our Website at any time (subject to any planned or unplanned downtime). All Services ordered from the Website will be delivered to the email address provided by you or physical address (where applicable) specified. You must pay for the Services online at the time you agree project start after initial communications and agreed fees. If you entered a valid email address and your order and payment are accepted by us, your order will be shipped pursuant to the terms above. AD3LONDON will send a proof of purchase of the Services to the email address you provide. 9. Legal

These Terms are governed by English law. By signing into an agreement with us, you acknowledge to have read and understood these terms and additionally acknowledge that these Terms are legally binding against you and enforceable. You and we both agree to submit to the non-exclusive jurisdiction of the English courts.
